TERMS AND CONDITIONS

1. the seller

The PUNCH GROUP company hereinafter referred to as “PG”, publisher of the innovi-pro.com site, having its registered office at 120 route des macarons, 06560 Valbonne.

2. Product presentation

The products offered for sale are described as much as possible. However, if errors or omissions may have occurred in this presentation, PG cannot be held liable. The photographs illustrating in support of the text do not enter the contractual field, only the texts are.

3. Product prices

Prices are presented in euros excluding taxes. The amount of VAT is indicated in the shopping cart page. PG reserves the right to modify its prices at any time but the products are invoiced at the price in force when the order is placed. VAT is not charged for delivery outside the European Union, unless otherwise stated on our site.

4. Order and payment

After having validated his method of payment, the customer validates definitively and irrevocably his order with the effects indicated below.

Product prices are exclusive of taxes and shipping costs. The prices invoiced are those specified in the basket during the online payment process and include VAT and shipping costs. Invoices are payable according to the payment terms agreed on the site and failing this before delivery of the planned product.

Delivery will only be made after receipt of full payment. Any complaint or claim from the CUSTOMER may in no case have the effect of deferring or suspending payments.

* Payment by credit card on the site

The Customer confirms his delivery and billing address, the product and the total price. He provides his bank card number associated with the expiration date and the CVX code. He finally validates his order by clicking on the “Confirm” button.

* Payment by bank transfer

The Customer who orders by bank transfer makes a transfer with his order number marked on the PG account that will be provided after his request or that he will find directly on the website.

For all payment methods, a color front / back copy of a perfectly legible identity document, the transfer transaction notice and proof of address may be requested.

In the event of a debit or collection for the order of an item which may no longer be available, PG undertakes to offer a credit or to reimburse the Customer within 3 weeks.

PG undertakes to notify by e-mail the Customer who has ordered an unavailable item.

These payment conditions are valid for individuals and professionals unless requested and agreed with PG.

5. delivery

a-modalities:

Delivery will be made, to the address indicated when ordering, by DPD or any other carrier chosen by PG. Delivery is made by direct delivery of the product to the recipient at the address indicated when ordering against signature of the latter, or in case of absence, to another person authorized by the customer, also against signature.

It is the Customer’s responsibility to always check their package on arrival.

** Damage / Missing packages

The products are delivered to the address indicated by the customer on the order form. The customer is required to check the condition of the packaging and the goods on delivery and to indicate the reservations on the transport receipt, then confirm by registered letter with acknowledgment of receipt within 48 hours, the written reservations. reported to the carrier at the latter’s address (address indicated on the transport receipt) and notify PG by e-mail to the address info@innovi-pro.com specifying in the subject line “transport dispute”.

* Delivery error / non-conformity

The customer must formulate with the company PG on the same day of delivery or at the latest on the first working day following delivery, any claim of delivery error and / or non-conformity of the products in kind or in quality with respect to the details on the order form.

The formulation of this complaint with the company PG can be made:

* by e-mail to the following address info@purifierdair.com: specifying in the subject line “delivery error”.

Any complaint not made in accordance with the rules defined above and within the time limits will not be taken into account and any liability of the company PG vis-à-vis the customer.

Upon receipt of the complaint, the company PG assigns an exchange number for the product (s) concerned and communicates it by e-mail, fax or telephone to the customer. The exchange of a product can only take place after the attribution to the customer of an exchange number according to the procedure presented above.

The product (s) must be returned as a whole and in its original packaging with the invoice and delivery slip, to the address that PG will have communicated to the customer when the exchange number was allocated. The shipping costs are the responsibility of the company PG, except in the event that the returned product does not correspond to the original declaration made by the customer in the return slip.

* We advise you to check the delivery address carefully during the order summary. In the event of an error in the shipping address, the shipping costs for a new shipment will be borne by the customer.

The choice and purchase of a product is the sole responsibility of the customer. The total or partial impossibility of using the products, in particular due to incompatibility of the equipment, cannot give rise to any compensation, reimbursement or questioning of the liability of PG, except in the case of a proven hidden defect, of non-conformity, of defect.

b-Delivery rates

Shipping rates are communicated on the site. These prices vary according to the distribution zones, the weight of the package, and the mode of transport chosen by the customer.

What are the shipping costs for deliveries to France?

Shipping costs are not included in our prices; they are calculated when you put your item in your basket for any delivery on French territory.

What are the shipping costs and taxes for deliveries to EU countries?

For all deliveries to a country in the European Union, shipping costs vary depending on the delivery territory (delivery estimate calculated when you put your item in your basket) and VAT varies depending on the country of destination of your order.

c- delivery times:

Delivery times are indicated online for information only, taking into account technical production contingencies and subject to the CLIENT’s compliance with its contractual obligations (including acceptance of documents and payment of the price). No compensation is due by PUNCH GROUP for late delivery.

6. GUARANTEE

6.1 The Products: Air purifier and surface disinfector

PUNCH GROUP guarantees for 2 years that the Products comply with the technical specifications defined in the Contract, subject to customary tolerances. PUNCH GROUP guarantees for 1 year the accessories and consumables associated with the PRODUCTS delivered.

The Products sold by Punch Group are guaranteed from the date of purchase against any material failure for a period of 2 years, except for an additional warranty extension offered online.

Upon receipt of the Products, the CUSTOMER must verify them and, in the event of a defect or non-conformity, immediately inform PUNCH GROUP in writing and provide it with all the information likely to characterize the nature of the defect observed.

The Parties undertake to cooperate in carrying out the contradictory analysis of the defects observed in order to determine their origin. PUNCH GROUP does not guarantee the suitability of the Products for a specific use, nor the performance or other specifications that are not explicitly specified in the Contract.

If you have a hardware problem with your air purifier or surface disinfector, please contact our after-sales service or the distributor who sold you the product.

Improper use of the device automatically voids the warranty. The warranty does not cover malfunctions or damage caused by the user or by an external cause (examples: product fall, shock, lightning, etc.). The warranty also does not cover devices that have not been properly maintained. For Hepa filter air purifiers, it is therefore essential to change your filters at most every 12 months to avoid damaging the device. For ion tube purifiers it is necessary to clean the tube every 12 months and change it every 24 months.

The warranty does not cover normal wear and tear of the product.

6.2 Additional elements not covered by the guarantee

The warranty does not cover consumables such as filters, UV lamps, ion tubes or control terminal batteries. Neither is covered:

2.1 Any leakage or spillage of liquid on or in the products and causing the device to malfunction.

2.2 Problems caused by unauthorized modifications to the device.

2.3 Problems caused by accidental dropping while using or handling the device.

2.4 Problems caused by use not in accordance with the instructions in the manual.

2.5 Damage caused by natural disasters (fires, earthquakes, floods, lightning, etc.).

6.3. Return conditions

In the event of a claim or material defect during the warranty period, the parts are insured by PUNCH GROUP. PUNCH GROUP modifies, repairs or replaces, at its option, the Products recognized as defective.

Return costs are the responsibility of the customer. In the event of non-conformity of the Product or of material failure proven during the period of the warranty, the return costs will be reimbursed to the Customer according to a scale established according to the location of the said Customer.

Shipping and repair costs will be covered by PUNCH GROUP during the first two years of warranty. Beyond that, shipping and repair costs will be borne by the customer, only the price of the parts will be covered by PUNCH GROUP as part of an additional warranty extension.

To be able to benefit from the warranty, you must keep the purchase invoice, product packaging and all components (purifier and accessories). You must return your device in its original packaging.

In the event that the product is incomplete, damaged or deteriorated by the customer, including during transport for the return of the product, the customer cannot invoke the Guarantee. The product must be shipped in its original packaging.

The customer will have to print the return slip by his own means.

6.4 Initiate a return

To initiate a return, please contact PUNCH GROUP or the PUNCH GROUP distributor who sold you the product. Please indicate the reasons for the return by email to info@innovi-pro.com.

We will then provide you with a return number and a return slip, if applicable.

If it turns out that the item cannot be repaired or exchanged, a credit or refund will be offered.

The refunded amount will include the purchase amount of the product, as well as the delivery costs, with the exception of additional costs resulting from the customer’s choice of a type of delivery other than the cheapest standard delivery type offered by PUNCH. GROUP.

For hygienic reasons, the original filter supplied with your air purifier cannot be reimbursed if you have used your air purifier. The cost of the filter will be deducted from the amount of your order when refunding.

6.5 Repair and replacement times

We always do our best to keep downtime as much as possible. The times to receive a repaired product or a replacement product are usually 2 to 8 weeks and are likely to vary depending on various constraints (processing times, transport, replenishment of spare parts, etc.).

In the event that the product is incomplete, damaged or deteriorated by the customer, including during transport for the return of the product, the customer cannot exercise the right of withdrawal. The product must be shipped in its original packaging.

7. GDPR

We collect the data to ensure the delivery of your orders, its follow-up and our communication. The data collected are your first and last names, delivery and billing addresses, email, telephone number, delivery method and type of payment. Passwords are encrypted and payment information is not collected by PG but only by external and secure payment systems on Paypal and Stripe. The retention period of the data we collect is from 3 to 10 years depending on the media and according to legal requirements, product guarantees or device returns. You have the right to access, modify or delete your data by contacting customer service.

8. Liability

For all stages of access to the site, consultation, filling in forms, ordering, delivery of items or any other service, the company PG has only an obligation of means. Consequently, PG cannot be held liable for any inconvenience or damage inherent in the use of the Internet network and totally outside the diligence and precautions taken by PG. In particular, any disruption in the provision of the service, or any external intrusion or presence of computer virus, cannot engage the responsibility of PG.

The responsibility of PUNCH GROUP can only be engaged in the event of serious fault of its fact and for the direct damage caused by its fault, to the exclusion of any immaterial or indirect damage (commercial damage, loss of customers, loss of order , loss of production, loss of profit, commercial disturbance, loss of profit, damage to the brand image, third party claims, malfunction of the air conditionner in which is placed innovi air system etc.) and within the limit of the sums paid by the CUSTOMER to PUNCH GROUP under the Contract. No claim, whatever it is, can be presented more than one year after the occurrence of the chargeable event.

In addition, it is the Customer’s responsibility to take note of the precautions for the use of products sold by PG appearing in the user manuals for each respective product, and to comply with them. For example, the use of automatic disinfectors for ozon-generating surfaces must be used without human presence in the room.

9. CANCELLATION AND TERMINATION

The validly formed Order cannot be canceled or terminated. The amount of the order is due in its entirety upon signing the Order Form.

10. Disputes

This contract is subject to French law, both for the substantive rules and for the formal rules. In the event of a dispute and in the absence of an amicable agreement between the parties, express jurisdiction is attributed to the courts within the jurisdiction of the head office of the company PG, notwithstanding a guarantee call or multiple defendants, even for emergency procedures or procedures conservatories in summary or by request.

In accordance with Article L156-1 of the Consumer Code, the customer is informed of the possibility of resorting, in the event of a dispute, to a conventional mediation procedure or any other alternative dispute resolution method. He is also informed of the existence of the platform put online by the European Commission, the purpose of which is to collect any complaints arising from an online purchase from European consumers and then to transmit the cases received to the competent national ombudsmen: http://ec.europa.eu/consumers/odr/.

As from the acceptance of these T & Cs by the Client, the SAS Punch Group known under the  name Innovi reserves the right to quote the name of the Client as a reference in any advertising, commercial and institutional document (in particular on its Site), which the Customer expressly declares to accept.
